Volkswagen admitted seven years ago to cheating U.S. diesel engine tests, sparking the biggest crisis in its history and costing the carmaker more than 32 billion euros ($37.7 billion) in vehicle refits, fines and legal costs so far. Well, Icarus was too excited at the thought of flying like a bird to think of anything else. With his great white wings, he would fly far better and further than his cousin. His father Daedalus gave Icarus a quick, anxious kiss, then said, “Now, Icarus! Jump! Icarus did as he was told and together with his father, he rose slowly into the air. Like in Greek literature, the German automobile industry created their own tragedy. A former German car manager, who was on trial over the car maker’s emissions-cheating scandal, blamed company culture for his and others’ silence on the matter, but said he would have acted differently had he known the consequences. Business organizations like Mercedes-Benz Group AG (Previously Named Daimler AG) operating in the global marketplace act through employees and agents, and pursuant to respond at superior, employee and agent conduct can expose a business organization to legal liability, both criminal and civil. It was melting! Suddenly, instead of flying, Icarus was falling. Below him as he fell, he saw his two wings being thrown about by the wind. They had come off. Down, down Icarus plunged, faster and faster.  After a tentative start in the early 19th century, development of the internal combustion engine accelerated from the 1870s thanks to Gottlieb Daimler and Karl Benz. These men produced the first motorized, gasoline-fueled vehicles in 1885. Both men are turning in their graves today most probably. The legendary system of Daimler AG was cracked wide open by one whistleblower. In the eyes of the dual enforcers (the U.S. Department of Justice and the Securities and Exchange Commission), the answer seems to be yes. The DOS and the United States Securities and Exchange Commission have been generating reams of evidence.

Another Whistleblower SEC Complaint Filed Against Daimler AG Echoes The Icarus Tale

According to the Rich TVX News Network, another whistleblower SEC complaint filed against Daimler AG echoes the Icarus tale. But differs in one crucial respect: Icarus dies from his hubris; Daimler AG (Mercedes-Benz Group AG) does not. A new massive Mercedes-Benz /Daimler Scandal shakes things up in the German automobile industry. Things were becoming too serious for Mercedes-Benz Group AG though, and the story became much bigger and more high profile than they thought it would. The whistleblower allegations swirling around Mercedes-Benz Group AG (Previously Named Daimler) are expected to generate more negative headlines for the German multinational automotive corporation headquartered in Stuttgart over the coming months. The whistleblower’s allegations are serious and can be very dangerous for the German car company; Violations of the Foreign Corrupt Practices Act, including at a minimum,15 U.S.C. §§ 78m(b)(2)(A), 78 m(b)(5), and 78ff(a), 15, U.S.C. §§ 78dd-1(a)(1)(A)(i) and (a)(3)(A)(i), as well as violations of 18 U.S.C. 2 and 18 U.S.C. 371. The Foreign Corrupt Practices Act scrutiny and enforcement actions have also originated from whistleblower complaints. For instance, the 2010 Daimler The Foreign Corrupt Practices Act enforcement action — which involved ‘a decade-long scheme involving tens of millions of dollars’ and ‘bribes in exchange for  business around the world’ — originated, per the U.S. Department of Justice’s sentencing memorandum. It is first necessary to understand and appreciate why the Foreign Corrupt Practices Act became a law. As with most new laws, the Foreign Corrupt Practices Act did not appear out of thin air. The Foreign Corrupt Practices Act is about bribery, at least a certain type of bribery — bribery of foreign officials. Bribery of course is bad. If the evidence supports the allegations, the U.S. Department of Justice (DOJ) may elect to intervene and take the lead in the enforcement action.
